An investigation has found that two Sherburne County sheriff's deputies acted properly during a confrontation that ended in the shooting death of a Big Lake man at the courthouse in Elk River last fall.

The investigation, conducted by the state Bureau of Criminal Apprehension and Wright County Attorney Thomas Kelly to avoid conflicts of interest within Sherburne County, determined that the deputies' actions were necessary and justified under state law.

On Oct. 2, Dana Dempsey, 47, was at the Sherburne County Courthouse to be sentenced for making methamphetamine. When he didn't appear, deputies found him in the parking lot. Dempsey pulled a gun and fired at two of them, authorities said. He was hit in return fire and died a short time later.
